Shulin District, New Taipei City, Taiwan, November 25, 2022 \u2013In response to Nichia\u2019s press release on November 24 about the Germany proceeding, Everlight believes the favorable evidences submitted by WOFI were not considered, and WOFI will appeal in accordance with the law. Everlight states that the proceeding is still in progress and is not a final judgment. Everlight firmly believes that a favorable judgment will be obtained. Everlight declares that Nichia\u2019s European patent EP936682 (and its equivalent Germany counterpart Germany patent DE69702929) was expired on July 29, 2017. Therefore, Everlight\u2019s and WOFI\u2019s products are not affected in any way.

<\/strong>Everlight has filed invalidation trial procedures against Nichia \u2018s YAG patents in Europe, United States, Australia, China and Taiwan. Everlight has received these winning judgements:<\/strong><\/p>

  1. Boards of Appeal of European Patent Office has decided that Nichia\u2019s European patent EP2197053 is invalid.<\/strong><\/li>
  2. Supreme Court of United States has decided that the asserted claims of Nichia\u2019s United States patents US5998925 and US7531960 are invalid.<\/strong><\/li>
  3. High Court of Australia has decided that the asserted claims of Nichia\u2019s Australia patent AU720234 are invalid.<\/strong><\/li>
  4. China Supreme People’s Court has decided that Nichia\u2019s China patent CN200610095837.4 is invalid.<\/strong><\/li>
  5. Taiwan Supreme Administrative Court has decided that Nichia\u2019s Taiwan patent TW383508 is invalid. Everlight reiterated that the facts of winning the above cases remain unchanged.<\/strong><\/li><\/ol>
